Terms of Service

Effective June 11, 2026. By using TowMile you agree to these Terms.

1. What TowMile is (and is not)

TowMile is a marketplace that connects riders who need roadside help with independent third-party shops and operators, and facilitates payment between them. We are not a towing or roadside-assistance company. We do not employ the shops, perform the service, or supervise how it is done. Shops are independent businesses solely responsible for their own work, equipment, licensing, and insurance.

When a shop accepts your job, you enter into a service contract directly with that shop. TowMile facilitates the introduction, payment, and messaging, but is not a party to that service contract. Disputes about service quality, damage, theft, or timing are between you and the shop, subject to Section 7.

2. Eligibility

You must be at least 18 and able to form a binding contract. Shops must be legally authorized to provide roadside services in their area and to receive payment.

3. How the marketplace works

You request help and we offer the job to nearby shops one at a time until one accepts. Before acceptance you see a shop's name, rating, distance/ETA, verification status, and price — contact details are revealed only after a shop accepts. Prices are set by the shops; the price you see at request time is what you agree to, subject to changes you and the shop agree to in person (for example if the actual job differs from what was described).

4. Payments and fees (riders)

  • Browsing and requesting are free. You add a payment card before or at the time of a job; payments are processed by Stripe.
  • When a shop accepts, we place an authorization hold on your card for the job price plus a flat $2.99 service fee. The hold is captured when the job is completed.
  • Cancellations & no-shows: cancelling before a shop is on the way releases the hold at no charge. If you cancel after the shop is already en route or has arrived, a cancellation fee (currently up to $25) may be charged to compensate the shop, and the remainder of the hold is released.
  • Your card statement will show TOWMILE. Refunds and billing disputes are handled per Section 7.

5. Shop terms and payouts

If you operate as a shop, you act as an independent contractor, not an employee or agent of TowMile. You are responsible for your own taxes, licensing, vehicles, equipment, and insurance, and for performing each accepted job safely and lawfully.

  • Payouts are made through Stripe Connect. You must complete Stripe's onboarding (identity and banking details) to be paid. Stripe's Connected Account Agreement applies to you.
  • TowMile retains a 5% platform commission on the job price; you receive the remaining 95%, paid out on Stripe's standard schedule. The rider's $2.99 service fee is retained by TowMile.
  • To get a Verified badge you must upload valid insurance and licensing. You represent that all documents you submit are accurate and current. Submitting false documents may result in removal and legal action.
  • You must not solicit riders to pay or transact off-platform to avoid fees. Doing so may result in suspension.

6. Ratings and conduct

After a job, riders and shops may rate each other. Ratings must be honest and based on the actual experience. We may remove ratings or content that is fraudulent, harassing, or unlawful, and may suspend accounts for abusive behavior, fraud, harassment, or repeated cancellations. You may not impersonate others, create accounts for other people, or use the service for any unlawful purpose.

7. Disputes and refunds

If something goes wrong with a job, open a dispute in the app or email [email protected]. We will review the job, messages, and payment record and may, at our discretion, issue a refund of the service fee and/or facilitate a resolution. Because the service is performed by the shop, claims about service quality, property damage, or theft are ultimately between you and the shop; TowMile may assist but is not liable for the shop's conduct (see Sections 9–10).

8. Account use and security

Authentication uses one-time codes sent to your phone or email — keep them secure; anyone with access to that inbox can log in as you. Notify [email protected] immediately if you suspect unauthorized access. You may delete your account anytime under Profile → Delete account.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TOWMILE DOES NOT WARRANT THAT ANY SHOP IS AVAILABLE, QUALIFIED, INSURED, OR LICENSED, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. A VERIFICATION BADGE REFLECTS DOCUMENTS A SHOP SUBMITTED AND IS NOT A GUARANTEE. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TOWMILE AND EXPRESS SERVICES GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING DAMAGES CAUSED BY A SHOP OR OPERATOR YOU CONNECTED WITH THROUGH TOWMILE. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID TOWMILE IN THE PRIOR THREE MONTHS OR ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold TowMile, Express Services Group, and our personnel harmless from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from (a) your use of the service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) for shops, the services you perform.

12. Governing law and dispute resolution

These Terms are governed by California law, without regard to conflict-of-laws principles. Any dispute relating to these Terms or the service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Fresno County, California. You and TowMile waive any right to a jury trial or class action. You may opt out by emailing [email protected] within 30 days of first using the service, subject "Arbitration Opt-Out."

13. Changes to these Terms

We may update these Terms. Material changes will be announced on this page at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
